Public Notices

A public notice is the primary method the Corps uses to advise interested parties of a proposed activity for which a Department of the Army permit is being sought. The Corps solicits comments and information to evaluate the probable impacts of the proposed activity on the public interest. Public notices are also used to inform the public about new or proposed regulations, policies, guidance, or permit procedures.

Public Notices issued by the Sacramento District are posted on this page and can be found on the Corps’ Regulatory Request System (RRS). Once a public notice is available on-line, an email notification is sent to individuals who signed up to receive our public notices.  Comments, which are due by the expiration date of the public notice, should be submitted through the RRS. Only comments submitted through the RRS, by email, or in hard copy format through a delivery service, such as the U.S. Postal Service, can be accepted. Hard copy comments must be submitted to the address listed in the public notice.

  • SPK-2017-00424, Public Notice of Permit Application/Request for 408 Permission, BALMD Sacramento River Erosion Control RM 14.6-17.55, Sacramento County, CA

    Expiration date: 2/22/2021

    The U.S. Army Corps of Engineers, Sacramento District, (Corps) is evaluating a permit application from the Brannan-Andrus Levee Maintenance District (BALMD) to construct the BALMD Sacramento River Erosion Control RM 14.6-17.55 project, which would result in work in/the discharge of fill material into approximately 6.33- acres of waters of the United States, including wetlands, in or adjacent to . In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, the BALMD has also requested permission through the Central Valley Flood Protection Board (#19173) from the Corps to alter the Sacramento River Flood Control Project, an existing federal flood risk management project. This notice is to inform interested parties of the proposed activity and to solicit comments.

  • SPK-2016-00894, Public Notice of Permit Application, Ranch Meadows Subdivision, Utah County, UT

    Expiration date: 2/25/2021

    Arive Homes, LLC has applied for a permit to retain 1.83 acres of fill material and the additional discharge of fill material into 0.17 acre of waters of the United States to resolve the violation associated with the 2016 construction of the Ranch Meadows subdivision and the additional fill within wetlands for the construction of an outbuilding for Lot #4. The approximately 6-acre project site is located at 400 North and 650 East, Latitude 40.05974°, Longitude -111.66134°, Salem City, Utah County, Utah, and can be seen on the Spanish Fork USGS Topographic Quadrangle.

  • Public Notice Federal Register Notice Announcing The Reissuance Of The Nationwide Permits

    On January 13, 2021, the U.S. Army Corps of Engineers (Corps) published a final rule in the Federal Register (86 FR 2744) announcing the reissuance of 12 existing nationwide permits (NWPs) and four new NWPs, as well as the reissuance of NWP general conditions and definitions with some modifications.

    Neils Lunceford, Incorporated, has applied for a permit to discharge dredged or fill material in approximately 1.23 acres of waters of the United States (WOTUS) to construct a landscaping business operations yard for material and equipment storage, project staging, nursery, and retail sales space. The approximately 10.02-acre project site is located in wetlands and an intermittent channel within the Town of Silverthorne, at 981 Adams Avenue, directly west of the intersection of 9th Street and Adams Avenue, within the SW ¼ SW ¼ of Section 1, Township 5 South, Range 78 West, 6th Principal Meridian, centered at 39.640206° Latitude, -106.080397° Longitude, Summit County, Colorado, and can be seen on the Dillion USGS 1:24K Topographic Quadrangle.

    The Port of Stockton has applied for a permit to conduct work and discharge fill material in approximately 21 acres of waters of the United States to construct a soda ash export terminal. The approximately 194-acre project site is located in the Port of Stockton’s West Complex on Rough and Ready Island and is bound by the San Joaquin River on the north and east and by the Burns Cutoff on the south and west, Latitude 37.956199°, Longitude -121.375389°, San Joaquin County, California, and can be seen on the Stockton West USGS Topographic Quadrangle.

  • SPK-2020-00005, U.S. Army Corps of Engineers Regulatory Program in the State of Colorado

    Effective May 16, 2021, the U.S. Army Corps of Engineers (Corps), Albuquerque District, will administer the Corps’ Regulatory Program in the following counties in the State of Colorado: Archuleta, Delta, Dolores, Eagle, Garfield, Grand, Gunnison, Hinsdale, La Plata, Mesa, Mineral, Moffat, Montezuma, Montrose, Ouray, Pitkin, Rio Blanco, Routt, Saguache, San Juan, San Miguel, and Summit (Western Slope Counties), instead of the Sacramento District. The Corps’ Omaha District will continue to administer the Regulatory Program for counties in the Front Range.

  • SPK-2014-01100, Public Notice of In-Lieu Fee Program Establishment within Colorado Western Slope Boundaries of Sacramento District

    The U.S. Army Corps of Engineers, Sacramento District, (Corps) in cooperation with an Interagency Review Team (IRT) has signed the National Forest Foundation’s (NFF) Sacramento District Colorado Western Slope In-Lieu Fee (ILF) Program Enabling Instrument, effective October 13, 2020. The IRT consists of the U.S. Environmental Protection Agency, Region VIII; the Colorado Parks and Wildlife; and the Corps. This establishes an In-Lieu Fee Program as a compensatory mitigation option in western portions of Colorado within the Sacramento District. Other third-party mitigation options with available credits for sale in Colorado within the Sacramento District include Animas River Wetlands, Finger Rock Preserve, and WetBank Gunnison mitigation banks.

  • SPK-2002-50464, Public Notice of Reissuance of Programmatic General Permit 10 - Minimal Impact Activities under State of Utah Stream Alteration Program.

    The U.S. Army Corps of Engineers, Sacramento District, is proposing to reissue Programmatic General Permit 10 (PGP 10) with modifications for regulated activities in waters of the U.S. under Section 10 of the Rivers and Harbors Act of 1899 or Section 404 of the Clean Water Act that are also authorized by the State of Utah under its Stream Alteration Permit Program.

  • NOTICE ON 2020 CLEAN WATER ACT SECTION 401 CERTIFICATION RULE

    This public notice is provided to inform stakeholders and prospective applicants seeking Department of the Army permits from the Sacramento District of the U.S. Army Corps of Engineers under the Regulatory Program of procedural requirements in newly promulgated regulations for Section 401 of the Clean Water Act by the U.S. Environmental Protection Agency.

    Colorado Stone Quarries, Inc. has applied for an after-the-fact permit to retain fill material that had been previously discharged into approximately 1,600 linear feet (0.60 acre) of waters of the United States (WOTUS) for the purpose of expanding an existing marble mining operation. The approximately 25-acre project site is located on Yule Creek at the Pride of America Mine approximately 3 miles south of the Town of Marble, at Latitude 39.036826°, Longitude -107.168673°, Gunnison County, Colorado, and can be seen on the Marble USGS Topographic Quadrangle.

    Expiration date: 10/31/2020

    The U.S. Army Corps of Engineers, Sacramento District, (Corps) is evaluating a permit application for a common-carrier freight rail system that would connect the Uinta Basin to the interstate common-carrier rail network. The project would result in impacts to waters of the United States including 14.78 acres of wetlands, 0.09 acre of playa, 56.41 miles (44.45 acres) of perennial, intermittent, and ephemeral streams, 5.1 miles of canals and ditches, and 1.28 acres of open-water features. This notice is to inform interested parties of the proposed activity and to solicit comments.

  • SPK-2012-00286, Public Notice of In-Lieu Fee Project Proposal for Funding from the Sacramento District California In-Lieu Fee Program for an In-Lieu Fee Project in the Cache/Putah Rivers Aquatic Resources Service Area

    The U.S. Army Corps of Engineers, Sacramento District (Corps) is soliciting comments regarding an In-lieu Fee Project (ILF Project) proposal, requesting funding from the Sacramento District California In-Lieu Fee Program (ILF Program). The Sponsor for this ILF Program is the National Fish and Wildlife Foundation (NFWF). This ILF Program services 37 counties and approximately 65,000 square miles. The ILF Program was established in October 2014 and was approved by the Corps, the U.S. Environmental Protection Agency, the National Marine Fisheries Service, the California State Water Resources Control Board, the Central Valley Regional Water Quality Control Board, and the Lahontan Regional Water Quality Control Board (each an “Agency” and collectively the “Agencies”).

    On September 15, 2020, Corps Headquarters published in the Federal Register its proposal to renew and revise 52 Nationwide Permits (NWPs) and issue five new NWPs for work in wetlands and other waters that are regulated by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899. In addition, the Sacramento District is seeking comments on proposed NWP regional conditions and/or the need for any additional regional conditions to help ensure that impacts authorized by the proposed NWPs are no more than minimal. The proposed regional conditions are applicable for activities in California, Nevada, and Utah, within the Sacramento District.
