Public Notices

A public notice is the primary method the Corps uses to advise interested parties of a proposed activity for which a Department of the Army permit is being sought. The Corps solicits comments and information to evaluate the probable impacts of the proposed activity on the public interest. Public notices are also used to inform the public about new or proposed regulations, policies, guidance, or permit procedures.

Public Notices issued by the Sacramento District are posted on this page and can be found on the Corps’ Regulatory Request System (RRS). Once a public notice is available on-line, an email notification is sent to individuals who signed up to receive our public notices.  Comments, which are due by the expiration date of the public notice, should be submitted through the RRS. Only comments submitted through the RRS, by email, or in hard copy format through a delivery service, such as the U.S. Postal Service, can be accepted. Hard copy comments must be submitted to the address listed in the public notice.

    Expiration date: 10/31/2020

    The U.S. Army Corps of Engineers, Sacramento District, (Corps) is evaluating a permit application for a common-carrier freight rail system that would connect the Uinta Basin to the interstate common-carrier rail network. The project would result in impacts to waters of the United States including 14.78 acres of wetlands, 0.09 acre of playa, 56.41 miles (44.45 acres) of perennial, intermittent, and ephemeral streams, 5.1 miles of canals and ditches, and 1.28 acres of open-water features. This notice is to inform interested parties of the proposed activity and to solicit comments.

  • SPK-2012-00286, Public Notice of In-Lieu Fee Project Proposal for Funding from the Sacramento District California In-Lieu Fee Program for an In-Lieu Fee Project in the Cache/Putah Rivers Aquatic Resources Service Area

    The U.S. Army Corps of Engineers, Sacramento District (Corps) is soliciting comments regarding an In-lieu Fee Project (ILF Project) proposal, requesting funding from the Sacramento District California In-Lieu Fee Program (ILF Program). The Sponsor for this ILF Program is the National Fish and Wildlife Foundation (NFWF). This ILF Program services 37 counties and approximately 65,000 square miles. The ILF Program was established in October 2014 and was approved by the Corps, the U.S. Environmental Protection Agency, the National Marine Fisheries Service, the California State Water Resources Control Board, the Central Valley Regional Water Quality Control Board, and the Lahontan Regional Water Quality Control Board (each an “Agency” and collectively the “Agencies”).

    On September 15, 2020, Corps Headquarters published in the Federal Register its proposal to renew and revise 52 Nationwide Permits (NWPs) and issue five new NWPs for work in wetlands and other waters that are regulated by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899. In addition, the Sacramento District is seeking comments on proposed NWP regional conditions and/or the need for any additional regional conditions to help ensure that impacts authorized by the proposed NWPs are no more than minimal. The proposed regional conditions are applicable for activities in California, Nevada, and Utah, within the Sacramento District.

    Newport Pacific Land Co., LLC has applied for a permit to discharge fill material in approximately 6.26 acres of waters of the United States to construct a mixed-use residential housing and commercial development. The approximately 979-acre project site is located on tributaries to Thomas Creek and Steamboat Creek, near center coordinates of Latitude 39.4639°, Longitude 119.7356°, Reno, Washoe County, Nevada, and can be seen on the Steamboat USGS Topographic Quadrangle.

  • SPK-2019-00899, Public Notice of Permit Application, Delta Conveyance, Sacramento, San Joaquin, Contra Costa, and Alameda Counties, California

    The California Department of Water Resources (applicant) has applied for a permit to place dredged and fill material and/or work in waters of the U.S., resulting in permanent impacts to approximately 247.44 acres of waters, temporarily impacts to 87.17 acres of waters, and subsurface crossings under 16.88 acres of navigable waters. The applicant would construct two water intakes and setback levees along the Sacramento River, 14 underground waterway crossings, including the Stockton Deep Water Ship Channel (SDWSC), thirteen tunnel shafts, a barge landing in the SDWSC, construction of south forebay facilities and connection to the existing State Water Project (SWP) Banks Intake Canal. The approximately 4,565-acre project site is located in the Sacramento-San Joaquin Delta (Delta), starting along the east bank of the Sacramento river at approximately latitude 38.38531°, longitude -121.51519°, and continuing south approximately 45 miles, to the existing south Delta pumping facilities at latitude 37.81358°, longitude -121.60311°, within Sacramento, San Joaquin, Contra Costa, and Alameda Counties, California.

    Valley Children's Hospital has applied for a permit to place fill material into approximately 1.05 acres of waters of the United States to construct infrastructure to support the Valley Children’s Hospital Complex. The approximately 120.0-acre project site is located near the San Joaquin River just west of State Route 41, in Sections 16, 17, 19, and 20, Township 12 South, Range 20 East, MDB&M, Latitude 36.88197°, Longitude -119.81054°, Madera County, California, and can be seen on the Fresno North USGS Topographic Quadrangle.

    ASB Southport II, LLC has applied for a permit to discharge dredged or fill material in approximately 5.51 acres of waters of the United States for the diversion and modification of existing drainage ditches and canals into a series of linear pond features, which will serve as storm drainage facilities for existing and future development. The project site is located between the Sacramento River Deep Water Ship Channel and the Sacramento River, in the southern portion of West Sacramento, Yolo County, California.

    The U.S. Army Corps of Engineers, Sacramento District, (Corps) is evaluating a permit application to construct the Smith Creek Crossing Development Road Access project, which involves two separate construction sites and would result in impacts to approximately 0.16 acre of waters of the United States (WOTUS). Proposed impacts to WOTUS include the permanent filling of approximately 0.11 acre of palustrine emergent fen wetlands and 0.05 acre of palustrine emergent wetlands associated with Smith Creek, which is tributary to the Colorado River. This notice is to inform interested parties of the proposed activity and to solicit comments.

  • SPK-2017-00905, Public Notice of Permit Application, Yolo Bypass Salmonid Habitat Restoration and Fish Passage, Yolo County, CA

    Expiration date: 8/5/2020

    California Department of Water Resources has applied for a permit to place dredged or fill material and/or work in approximately 62.09 acres of waters of the United States to construct a gated notch within Fremont Weir to allow increased flow from the Sacramento River to enter the Yolo Bypass. The invert of the notch would be 18 feet below the crest of Fremont Weir and allow a flow of up to 6,000 cubic feet per second through the gated notch to provide open channel flow for adult fish passage, juvenile emigration, and floodplain inundation. The proposed project would also construct an intake channel from the Sacramento River, a headworks structure, a transport channel to the existing Tule Pond, and modifications to the existing Tule Channel and Agricultural Crossing 1. The approximately 102.76-acre project site is located on the right bank of the Sacramento River, between River Mile (RM) 82 and RM 84, along the northern boundary of the Yolo Bypass, Latitude 38.764844°, Longitude -121.636151°, Yolo County, California.
