Public Notices

Under the Corps' Regulatory Program, a public notice is the primary method for advising all interested parties of a proposed activity for which a permit is sought. Soliciting comments and information necessary to evaluate the probable impacts on the public interest. Public notices are also published to inform the public about new or proposed regulations, policies, guidance or permit procedures.

Public Notices published by the Sacramento District under the Regulatory Program are posted on this page. Once a public notice is available on-line, an email notification is sent to individuals on the appropriate mailing list.

Comments are due by the expiration date of the public notice.  Only comments submitted by email or in hard copy format through a delivery service, such as the U.S. Postal Service, can be accepted.   Comments must be submitted to the address listed in the public notice.

SPK-2011-00384, RGP 12, Aquatic Habitat Improvement for Stream Channels in Colorado

SUBJECT: The U.S. Army Corps of Engineers, Albuquerque, Omaha, and Sacramento Districts (Corps) has reissued Regional General Permit No. 12 (RGP 12) for Aquatic Habitat Improvement in Stream Channels in Colorado. This notice is to inform interested parties of the reissuance and availability of RGP 12.

AUTHORITY: Section 10 of the Rivers and Harbors Act of 1899 for structures or work in or affecting navigable waters and Section 404 of the Clean Water Act for the discharge of dredged or fill material in all waters of the United States.

AREA OF COVERAGE: This RGP is applicable to all flowing waters of the U.S. within the State of Colorado.

SCOPE OF ACTIVITIES: Activities proposed to be authorized by this RGP are limited to work associated with aquatic habitat improvement activities in stream channels within the State of Colorado. For a full description of the activities and proposed conditions, see the attached draft permit. Activities which do not comply with the provisions of this RGP 12 may require an Individual Permit.

LENGTH OF AUTHORIZATION: This RGP 12 will expire on October 12, 2021.

OTHER GOVERNMENTAL AUTHORIZATIONS: The State of Colorado has certified the activities authorized by this permit under Section 401 of the Clean Water Act. For projects located on Southern Ute Indian Lands, the permittee must obtain an individual water quality certification (WQC) from the U.S. Environmental Protection Agency. For projects located on Ute Mountain Ute Indian Lands, the permittee must obtain a WQC from the Ute Mountain Ute Tribe. Please refer to RGP 12 General Condition 10 for more information on how to apply for an individual WQC for projects located in Indian Country.
