Public Notices

A public notice is the primary method the Corps uses to advise interested parties of a proposed activity for which a Department of the Army permit is being sought. The Corps solicits comments and information to evaluate the probable impacts of the proposed activity on the public interest. Public notices are also used to inform the public about new or proposed regulations, policies, guidance, or permit procedures.

Public Notices issued by the Sacramento District are posted on this page and can be found on the Corps’ Regulatory Request System (RRS). Once a public notice is available on-line, an email notification is sent to individuals who signed up to receive our public notices.  Comments, which are due by the expiration date of the public notice, should be submitted through the RRS. Only comments submitted through the RRS, by email, or in hard copy format through a delivery service, such as the U.S. Postal Service, can be accepted. Hard copy comments must be submitted to the address listed in the public notice.

  • SPECIAL PUBLIC NOTICE- The Navigable Waters Protection Rule is now in effect in Colorado

    SUBJECT: On April 21, 2020, the Environmental Protection Agency (EPA) and the Department of the Army’s Navigable Waters Protection Rule: Definition of “Waters of the United States” was published in the Federal Register. Colorado subsequently filed an amended motion for a preliminary injunction requesting the United States District Court for the District of Colorado enjoin the EPA and the Department of the Army from implementing the Navigable Waters Protection Rule in the State of Colorado. On June 19, 2020, the district court stayed the effective date of the rule and enjoined the EPA and the Department of the Army to continue administering Section 404 of the Clean Water Act in Colorado under the then-current regulations. The district court’s determination to grant Colorado injunctive relief under the Navigable Waters Protect Rule expired on April 23, 2021. The Navigable Waters Protection Rule is now in effect in Colorado.

  • SPK-2017-00529, Public Notice of Permit Application, Upper Mormon Slough Erosion and Flood Control, San Joaquin County, CA

    San Joaquin County Public Works has applied for a permit to discharge dredged or fill material in approximately 2.40 acres of waters of the United States to construct erosion control bank stabilization on the north and south banks of upper Mormon Slough. The approximately 20.20-acre project site is located on Mormon Slough, near the intersection of Highway 26 and Escalon Bellota Road, at approximate Latitude 38.04795°, Longitude -121.01662°, San Joaquin County, California, and can be seen on the Linden USGS Topographic Quadrangle.

    Expiration date: 5/9/2021

    Natural Resources Group, Inc. proposes to establish the approximately 89.6-acre Walker River Mitigation Bank. The project site is located on the West Walker River, approximately 3.2 miles north of Coleville and east of State Route 395, Latitude 38.604272°, Longitude -119.517347°, Mono County, California, and can be seen on the Coleville 24K USGS Topographic Quadrangle.

    Vulcan Materials Company has submitted a prospectus to the Corps to create the Fenston Preservation Bank to help compensate for projects that will place fill into waters of the United States. The approximately 1,206.16-acre vernal pool landscape project site is located in Sections 7 & 18, Township 11 South, Range 20 East, MDB&M, Latitude 36.98728°, Longitude -119.83184°, Madera County, California, and can be seen on the Little Table Mountain USGS Topographic Quadrangle.
