Public Notices

A public notice is the primary method the Corps uses to advise interested parties of a proposed activity for which a Department of the Army permit is being sought. The Corps solicits comments and information to evaluate the probable impacts of the proposed activity on the public interest. Public notices are also used to inform the public about new or proposed regulations, policies, guidance, or permit procedures.

Public Notices issued by the Sacramento District are posted on this page and can be found on the Corps’ Regulatory Request System (RRS). Once a public notice is available on-line, an email notification is sent to individuals who signed up to receive our public notices.  Comments, which are due by the expiration date of the public notice, should be submitted through the RRS. Only comments submitted through the RRS, by email, or in hard copy format through a delivery service, such as the U.S. Postal Service, can be accepted. Hard copy comments must be submitted to the address listed in the public notice.

AVAILABILITY OF ROD: On May 18, 2021, the U.S. Army Corps of Engineers, Sacramento District (Corps) completed a Record of Decision (ROD) for the Clean Water Act Section 404 (CWA 404) Permit Strategy Aligned with the PCCP, in accordance with the National Environmental Policy Act (NEPA), as a NEPA cooperating agency on the U.S. Fish and Wildlife Service’s (USFWS) Environmental Impact Statement (EIS) for the PCCP. The EIS was prepared by the USFWS; the Corps contributed to the EIS in our area of expertise and jurisdiction under CWA 404. The USFWS prepared the EIS to analyze the direct, indirect, and cumulative effects associated with applications for an Incidental Take Permit under section 10(a)(1)(B) of the federal Endangered Species Act. The Corps’ ROD follows the issuance of a Final EIS by the USFWS in May 2020. Appendix C of the Final EIS included a final draft of the Corps’ proposed CWA 404 permit strategy. In July 2019, the Corps issued a public notice to solicit comments on the final draft permit strategy. A copy of the ROD is attached to this public notice.

MULTI-TIERED CWA 404 PERMIT STRATEGY FOR PCCP COVERED ACTIVITIES: The Corps has issued Programmatic General Permit (PGP) 18 for Minimal Impact Covered Activities Under the Western Placer County Habitat Conservation Plan/Natural Community Conservation Plan. The Corps has issued Regional General Permit (RGP) 19 for Minimal Impact Activities Conducted by Placer County Water Agency (PCWA) under the Western Placer County Habitat Conservation Plan/Natural Communities Conservation Plan. The Corps has issued Regional General Permit (RGP) 20 for Minimal Impact Activities Conducted under the Western Placer County In-Lieu Fee Program (WPILF). The Corps has issued a Letter of Permission procedure for Covered Activities Under The Western Placer County Habitat Conservation Plan/Natural Community Conservation Plan With Less Than Significant Impacts on the Human Environment.
