Public Notices

Under the Corps' Regulatory Program, a public notice is the primary method for advising all interested parties of a proposed activity for which a permit is sought. Soliciting comments and information necessary to evaluate the probable impacts on the public interest. Public notices are also published to inform the public about new or proposed regulations, policies, guidance or permit procedures.

Public Notices published by the Sacramento District under the Regulatory Program are posted on this page. Once a public notice is available on-line, an email notification is sent to individuals on the appropriate mailing list.

Comments are due by the expiration date of the public notice.  Only comments submitted by email or in hard copy format through a delivery service, such as the U.S. Postal Service, can be accepted.   Comments must be submitted to the address listed in the public notice.

FINAL REGIONAL GENERAL PERMIT NO. 37

Issue Date: October 2, 2012

Expiration Date: October 2, 2017

Summary of Proposed Action: The U.S. Army Corps of Engineers, Albuquerque and Sacramento Districts, hereby issue Regional General Permit (RGP) No. 37 for Stream Stabilization Projects within the Albuquerque and Sacramento District areas of Colorado. The purpose of this public notice is to inform interested parties of the availability of the RGP.

Purpose & Need: The purpose of this RGP is to authorize stream stabilization projects that cause only minimal individual and cumulative environmental impacts.

Authority: Section 10 of the Rivers and Harbors Act of 1899 for structures or work in or affecting navigable waters and Section 404 of the Clean Water Act for the discharge of dredged or fill material in all waters of the United States.

Area of Coverage: The RGP is applicable to all waters of the United States, including wetlands, within the Albuquerque and Sacramento District areas of the State of Colorado.

Scope of Activities: Activities authorized by this RGP include installation/construction of bank stabilization, deflectors, and grade control structures. For a full description of the types of activities authorized by this RGP and the permit conditions, access the Corps web site @ www.spk.usace.army.mil/Media/RegulatoryPublicNotices.aspx. Activities that do not comply with the provisions of this RGP may require authorization by a Standard Individual Permit.

Length of Authorization: The RGP will expire five years from the date of issuance (October 2, 2017).

Other Governnemtal Authorizations: In Colorado, excluding Indian lands, regional general permits are unconditionally certified by statue. Projects located on Southern Ute or Ute Mountain Ute Indian Lands will require individual water quality certifications under Section 401 of the Clean Water Act.
